Questions

Q:        When should I consult an attorney regarding family matters?

A:         A family lawyer may be consulted at any time from the first contemplation of
cohabitation, engagement, marriage, considerations of adoption and when separation or divorce are possibilities, as well as when your children have issues at school.  It is during these times that sound legal advice can be of serious significance.

Q:        How much does a family attorney charge?

A:         Fees for family attorneys can vary greatly and it is important to understand what the cost will be to resolve your matter.  Depending on the circumstances, fees can be hourly or flat fee based.  Charges are most appropriately discussed during the free initial consultation.

Q:        I’m not divorced but my spouse no longer lives with me and we have children.  Can I receive child support during this time?

A:         Yes.  You do not have to have filed for divorce in order to request the Court award you child support and other maintenance.

Q:        My spouse filed for divorce.  Must I do something immediately?

A:         Once your spouse has filed a divorce Complaint, in most cases you will need to file an Answer within 30 days of properly receiving the Complaint.

Q:        My spouse filed for divorce and just handed me the paperwork.  What should I do?

A:         In order for a divorce Complaint to be properly served, it cannot be handed to you
by the other party directly.  There are multiple scenarios wherein service is proper so it is best to seek the advice of an attorney to determine if you have been properly served.

Q:        I need to file for divorce but cannot afford to.  What can I do?

A:         If you are at or below the poverty level due to loss of income from your spouse, New Jersey Legal Services may be able to arrange for pro bono (no fee) representation.  Alternatively, in certain circumstances you may be able to obtain the assistance of a private attorney who will request to the Court that your spouse pay for your costs in obtaining a divorce.
